Youtube daily report Oct 19 2018

THE FIRST CASE ON THE DOCKET THIS MORNING IS DAVID P. TROTTI V. RICK SCOTT, GOVERNOR, ET AL.. >> I AM PHILIP PADOVANO, HERE

WITH PETITIONER DAVID MATTHEW FUNDERBUNK. MISTER SALAMA WAS IN BOTH OF THE PROCEEDINGS IN THE DCA AND

CIRCUIT COURT. AFTER HEARING THE EVIDENCE IN THIS CASE THE TRIAL JUDGE SAID, QUOTE, THIS WAS SIMPLY AN EFFORT

TO CIRCUMVENT THE CONSTITUTION NOT TO SUPPORT THE DEFENDANT. JUDGE FOSTER RESIGNED BEFORE THE QUALIFYING IN THE GENERAL

ELECTION. GO BUT SET HIS RESIGNATION DATE 9 MONTHS IN THE FUTURE TO APPOINT JUST FOUR DAYS BEFORE THE END OF THE NATURAL

EXPIRATION OF HIS TERM AND THERE WAS NO REASON TO RESIGN IN THE FIRST PLACE. HE QUALIFIED FOR ANOTHER TERM.

>> LET ME CUT TO THE HEART OF WHAT WE ARE TALKING ABOUT. THE JURISPRUDENCE OF THIS BOARD HAS INTERPRETED THE RESIGNATION

AS BEING EFFECTIVE WHEN ACCEPTED. >> CORRECT. >> IN THIS CASE WHAT WE HAVE TO

DO IS A NUMBER OF CASES AS WE GET TO THE POINT. >> LET ME TELL YOU WHY. LET ME START WITH POINTS THAT WE

AGREE. WE AGREE THERE IS A BODY OF CASE LAW IN THIS COURT THAT SAYS RESIGNATION IS EFFECTIVE,

TENDERED AND ACCEPTED BY THE GOVERNOR. WE ALSO AGREED THIS COURT HAD ENCOURAGED LAWYERS, JUDGES TO

RESIGN IN THE FUTURE SO THE WORK OF THE NOMINATING COMMISSION CAN BE DONE SO THERE WILL BE A SEAMLESS TRANSMISSION IN THE

SERVICE -- >> THERE IS A HOLE IN THE CONSTITUTION. >> WHAT HAPPENS.

>> THESE CASES BASICALLY WERE FOUNDED ON THE PRINCIPLE OF GOOD FAITH THAT RESIGNATION WAS GOING TO BE A RESIGNATION IN THE

FUTURE. EVERY ONE OF THE CASES YOU'RE REFERRING TO THE EFFECTIVE DATE OCCURRED BEFORE THE GENERAL

ELECTION. THE FIRST CASE IT OCCURRED, AND THE RESIGNATION IS BEFORE THE QUALIFYING, BUT AFTER THE

QUALIFYING HAD CONCLUDED. IT WAS SOMETHING ON THE ORDER OF JULY 31ST OR EVEN SEPTEMBER. BECAUSE THERE ARE 6 OR 7 MONTHS

OF NOBODY IN THE OFFICE, AND THERE IS AN UNREASONABLE VACANCY. THIS DETERMINED, THE COURT

DETERMINED THE CASE UNREASONABLE VACANCY. IT IS ALL INVOLVED IN THAT CATEGORY.

WHAT I'M SAYING TO YOU IS I DON'T THINK THE COURT NEEDS TO MODIFY CASE LAW. THE COURT NEEDS TO DECIDE THOSE

CASES, AND THE COURT HAD IN MIND TO MAKE A MOCKERY OF THIS BY RESIGNING A DAY BEFORE THE END OF THE TERM, AND SWALLOWED UP AN

ENTIRE ELECTION. I DON'T THINK THAT IS WHAT THE COURT HAD IN MIND. >> WHAT THE COURT HAS IN MIND --

IT IS A QUESTION OF TRYING TO APPLY THE CONSTITUTION. >> THE CASE WAS DIRECTLY CONTROLLED BY THE COURT DECIDING

-- >> THE CONSTITUTION CHANGED THIS. >> THE CONSTITUTION DID CHANGE

BUT NOT MATERIALLY, AND DID CHANGE IN SOME RESPECTS. THE CONSTITUTION CHANGED IN RESPECT FOR AND MOST NOTABLY WE

NO LONGER ELECT JUDGES BACK THEN. WE WERE ELECTING FLORIDA SUPREME COURT JUSTICES.

CONSTITUTION CHANGED IN THE RESPECT THAT WE NOW HAVE A LONGER PERIOD, THAT CHANGED SEVERAL TIMES SINCE THEN.

THE MATERIAL PART OF SPECTER HAS NOT CHANGED. IF THERE IS AN ELECTION THE WILL OF THE PEOPLE MUST BE HONORED

AND WE MUST HAVE THE ELECTION, YOU HAVE A CASE WHERE THERE WAS NO REASON NOT TO HOLD AN ELECTION.

>> UNDER THIS SCENARIO THAT WE SANCTIONS AND AUTHORIZED, THERE WAS GOING TO BE NO PHYSICAL VACANCY.

>> UNLIKE WHAT WAS OBTAINED HERE, SMALL AND SOME PHYSICAL VACANCY SO THAT IS A DISTINCTION.

>> I CAN SEE THAT IS A DIFFERENCE. >> LET ME ASK YOU A HYPOTHETICAL.

THERE WAS A CIRCUIT JUDGE, THE TERM EXPIRING IN JANUARY 2021. A CIRCUIT JUDGE DECIDED SHE WANTED TO LEAVE OFFICE BEFORE

THE EXPIRATION OF HER TERM. ABOUT TWO YEARS BEFORE EXPIRATION OF HER TERM BUT SHE ALSO DECIDED SHE WOULD LIKE HER

SUCCESSOR TO BE CHOSEN BY ELECTION OTHER THAN BY APPOINTMENT. SO NOW IN 2018 BEFORE THE START

OF QUALIFYING PERIOD, THE FIRST TUESDAY AFTER THE FIRST MONDAY IN JANUARY 2019. UNDER YOUR THEORY OF OUR

CONSTITUTION, WHAT WILL HAPPEN? >> IT WOULD BE AN ELECTION AND IF I UNDERSTAND CORRECTLY THAT IS PRECISELY WHAT HAPPENED.

>> THE JUDGE COULD DECIDE IF THERE'S GOING TO BE A SPECIAL ELECTION UNDER THE WAY THE CONSTITUTION IS NOW.

>> DECIDING TO FOLLOW THE WILL OF THE PEOPLE AND HOLD AN ELECTION IN A LITTLE ELECTION YEAR, DECIDING TO TRY TO THWART

THAT. >> IT IS A SPECIAL ELECTION. >> JUST A SERVANT OF THIS COURT, HE DECIDED --

>> I'M NOT CRITICIZING. I'M TRYING TO EXPLORE WHERE YOUR THEORY OF THIS TAKES US. WHAT WAS INVOLVED IN SPECTOR WAS

A SPECIAL ELECTION THAT WAS SET AT THE TIME OF REGULARLY SCHEDULED ELECTION BUT STILL A SPECIAL ELECTION FOR THAT SEAT,

CORRECT? >> YES. >> THE SCENARIO INVOLVED A SPECIAL ELECTION FOR A CIRCUIT

COURT, CORRECT? >> I MISSED THE LAST POINT. >> THE SCENARIO I DESCRIBED, THE HYPOTHETICAL -- THERE SHOULD BE

A SPECIAL ELECTION, THE CIRCUIT COURT. >> IT IS A DIFFERENCE, FOR EXAMPLE A CIRCUIT JUDGE MIGHT

ANNOUNCE UNTIL EVERYBODY KNOWS THAT TO BE OPEN. ONE MIGHT CHARACTERIZE THAT AS A CONSCIOUS CHOICE ON THE PART OF

THE JUDGE TO FAVOR AN ELECTION. THIS IS AN ELECTION YEAR. >> A RESPONSE TO MY HYPOTHETICAL, YOU ARE SAYING

BASICALLY THE JUDGE CAN DECIDE THERE IS GOING TO BE A SPECIAL ELECTION TO FILL OUT A TWO YEAR PORTION OF THE JUDGE'S TERM,

CORRECT? >> PERHAPS I DON'T UNDERSTAND THE HYPOTHETICAL. >> WHAT DON'T YOU UNDERSTAND?

I AM TRYING TO BE CLEAR AND SOMETIMES I FAIL. >> I'M NOT LAYING THAT ON YOU. IN ANY EVENT WE HAVE A GENERAL

ELECTION HERE. THIS IS A GENERAL ELECTION YEAR IN 2018. >> THAT WAS THE CASE IN SPECTOR

BUT IT WAS NONETHELESS A SPECIAL ELECTION FOR THAT PARTICULAR SEAT. IT WAS NOT -- THE TERM IS NOT

UP. THERE WAS NOT GOING TO BE AN ELECTION FOR THAT SEAT AND THE SCENARIO I GAVE YOU IT WOULD BE

A SPECIAL ELECTION. IF I UNDERSTAND CORRECTLY THE JUDGE CAN DECIDE, AS IN SPECTOR, THAT THERE WILL BE A SPECIAL

ELECTION. >> I THINK I UNDERSTAND YOU BETTER AND I'M NOT SURE I WOULD ANSWER THAT, IT IS A DIFFERENT

SITUATION. >> HOW IS IT DIFFERENT FROM SPECTOR? >> SPECTOR ACTUALLY WAS AGING

OUT 20 DAYS AFTER. HE WOULDN'T -- >> THE TERM -- BY MANDATORY RETIREMENT, THE TERM WAS NOT UP.

>> THAT IS CORRECT. >> A SPECIAL ELECTION WOULD BE FILLED BY ELECTION, CORRECT? >> THERE WAS A GENERAL ELECTION

THAT YEAR. I'M NOT SURE WHAT THE SIGNIFICANCE OF THE -- THAT WAS AN ELECTION YEAR.

THERE WAS IN FACT A GENERAL ELECTION THAT YEAR. CANDIDATES FOR THE SUPREME COURT, ARTHUR ENGLAND DID

QUALIFY FOR THAT, TRIED TO. >> LET ME ASK YOU THIS. IN OUR CASE, THE LETTER WAS SENT BY JUDGE FOSTER PRIOR TO THE

QUALIFICATION, CORRECT? IT WAS TO HIS TERM, BY HIS TERMS WAS TO END AFTER THE QUALIFYING PERIOD.

>> CORRECT. >> WHAT WOULD BE THE RESULT IF HE HAD SENT HIS LETTER AWAY, A DAY, A WEEK, WHATEVER, AFTER THE

QUALIFYING PERIOD, WOULD THERE BE AN ELECTION YEAR? OR WE STILL FIGHTING ABOUT WHETHER OR NOT THERE WOULD BE?

>> THAT WOULD CLEARLY BE AN ELECTION. THAT GOES -- >> WE STILL GET TO THE POINT

WHERE A JUDGE CAN, BY THE DATE OF THE LETTER THAT IS SENT TO THE GOVERNOR, DETERMINE WHETHER THERE IS GOING TO BE AN ELECTION

OR APPOINTMENT? >> THAT IS CORRECT. WHAT I AM SAYING IS I DON'T THINK IT REFLECTS WELL ON THE

JUDICIARY, CONSISTENT WITH THE GENERAL, THE RURAL ANNOUNCED INSPECTOR TO DELIBERATELY RE-SIGN BEFORE THE QUALIFYING

BEGINS. KNOWING THAT WILL CREATE AN APPOINTMENT WHEN IN FACT YOU INTEND TO STAY FOR THE ENTIRE

YEAR. >> LET ME ASK YOU THIS. WHAT YOUR VIEW IS A REASONABLE VACANCY?

>> THE COURT -- >> IF HE SENT THIS LETTER, WOULD IT BE BY APPOINTMENT ACCORDING TO YOUR THEORY?

>> BY APPOINTMENT. >> THE JUDGE COULD DO THAT SUBJECTIVELY TO MAKE IT AN APPOINTMENT.

>> YES. >> YOUR CONCERN IS NOT REALLY WITH THE SUBJECTIVE INTENT BUT WITH THE LENGTH OF TIME.

>> THAT IS CORRECT. I THINK THAT IS CORRECT. >> LOOKING AT THE 2006 UNANIMOUS ADVISORY OPINION FOR THIS COURT,

IT SAYS UNDER PRIOR CASE LAW VACANCY OCCURRED IN THAT CASE, THE GOVERNOR RECEIVED AND ACCEPTED STEVENSON'S RESIGNATION

AND THAT IS THE POINT OF LAW THAT YOU AGREE WITH. >> THAT IS CORRECT. >> THAT GOES ON TO SAY BECAUSE

THE QUALIFYING PERIOD HAD NOT COMMENCED UNDER THIS COURT'S DECISION, THE ELECTION PROCESS HAS NOT YET BEGUN, THIS ARTICLE

5 SECTION 11 BE CONTROLLED, THE VACANCY SHALL BE FILLED BY APPOINTMENT. >> THAT IS ALL CORRECT.

>> IF WE WERE TO FOLLOW THAT, THEN THIS WOULD BE AN APPOINTED POSITION. >> THE DIFFERENCE AND IT IS A

BIG DIFFERENCES THAT INVOLVES AN ACTUAL VACANCY, LONG-TERM, FORGET HOW LONG. >> THAT WASN'T PART OF THE

REASONING, WAS IT? >> IN THE PREVIOUS CASE IT INVOLVED JUDGE FULLER, TALKING ABOUT THE FACT IT HAD TO BE

DIDN'T -- >> IT WAS A 7 MONTH VACANCY. >> YES. BECAUSE OTHERWISE AN

UNREASONABLE VACANCY, TO GO BACK TO YOUR EARLIER QUESTION I DON'T THINK THE COURT DEFINED WHAT AN UNREASONABLE VACANCY WAS.

I THINK THAT IS A GOOD ARGUMENT FOR SAYING THAT THE COURT DOESN'T NEED TO DEFINE A SHORT TIME.

>> LET ME ASK ABOUT THE PRACTICALITY OF THIS CASE AND PRECEDENT. OBVIOUSLY I AGREED WITH YOU,

YOUR DISSENT IN THE PRIOR ABCA13 CASE. THE HALLWAY OUR LAW HAS DEVELOPED INCLUDING WHETHER THE

VACANCY OR THE LETTER IS ACCEPTED BEFORE THE QUALIFYING PERIOD AND WE ARE RIGHT AFTER, CREATES AN ARBITRARINESS, SO TO

ME I SEE THAT THIS, WHETHER IT IS ALL LEGISLATIVELY, CONSTITUTIONALLY OR BY THE COURT BUT IN THIS SITUATION IT DOES

CONCERN ME THAT WE HAVE THE ALTERNATIVES WE HAVE A JUDGE IN THE WINGS WHO WAS, WENT THROUGH A JUDICIAL NOMINATING COMMISSION

PROCESS, WE CAN ASSUME OTHER QUALIFIED PEOPLE. AND APPOINTING HIM, AND THE SAME ABCA13, NOBODY ELSE PUT IN FOR

THE SEAT PRESUMABLY, RELYING ON PRECEDENT. IT CONCERNS ME FROM A PRACTICAL POINT THAT THE CHOICES HERE, AT

LEAST HERE, GOING FORWARD MAY BE DIFFERENT, WE SHOULD STICK WITH OUR PRESIDENT AND LET THIS GO BY APPOINTMENT AND PROSPECT OF THE,

DEPENDING, MAKE SURE THIS DOESN'T CONTINUE TO HAPPEN. WHAT DO YOU SAY ABOUT THE FACT OF THE POLICIES IN FAVOR OF

ELECTIONS THERE WASN'T ANY ELECTION HERE. >> WHAT I SAY IS THERE WAS AN ELECTION.

OF THE CONSTITUTION CALLS FOR ANY ELECTION IT CALLS FOR ANY ELECTION WHETHER ONE PERSON QUALIFIES ARE 10 PEOPLE QUALIFY

AND ALSO SAY THAT THERE IS PROVISION IN FLORIDA LAW THAT SAYS WHAT HAPPENS WHEN ONLY ONE PERSON QUALIFIES, THE PERSON

VOTED FOR HIMSELF OR HERSELF AND -- >> I SAYING THE REALITY IS WE HAD ONE PROCESS THAT WAS A FULL

PROCESS AND ANOTHER, I WOULD ASSUME THERE ARE MORE PEOPLE IN THE CIRCUIT. >> THAT IS RIGHT.

THE ANSWER TO YOUR BROADER QUESTION AND GETS TO A PROBLEM IN THIS CASE, ADVOCATING FOR ELECTIONS AND YET THERE WON'T BE

A CONTESTED ELECTION. THERE IS AN ELECTION, THERE WON'T BE A CONTESTED ELECTION. I UNDERSTAND THAT.

THAT IS A CONCERN THE FIRST DISTRICT EXPRESSED. I THINK THAT ONCE THIS PROBLEM IS RESOLVED, IF WE ADHERE TO

WHAT WE SAID IF THERE ISN'T MACHINERY FOR ELECTING, WE FOLLOW THAT BECAUSE THAT IS THE WILL OF THE PEOPLE.

OF LAWYERS GET THE IDEA THE COURT IS WILLING TO SUPPORT THE CONSTITUTIONAL RIGHT TO AN ELECTION, THIS ISN'T GOING TO

HAPPEN SO OFTEN. IT HAPPENED EVERY ELECTION CYCLE. IN THE FIRST MATTHEW FUNDERBUNK

CASE THERE WAS NOT MUCH INTEREST IN ELECTIONS. >> YOU ARE CONSUMING A REBUTTAL TIME.

>> I DO NOT. >> THANK YOU FOR REMINDING ME. >> ON BEHALF OF GOVERNOR SCOTT, AND THE CHIEF DEPUTY COUNSEL.

>> A FEW THINGS THAT CONCERN ME, AND THE PAST JURISPRUDENCE. VACANCY OCCURRING AT THE TIME THE RESIGNATION IS ACCEPTED.

IN THIS CASE, MORE RECENT CASES WERE ONLY A MATTER OF A DAY OR TWO DAYS OR THREE DAYS, THERE SEEMS TO BE SOMETHING UNINTENDED

WITH THAT, THAT SOMEBODY, MAYBE A MONTH OR WHATEVER, IS THAT TO THE CONSTITUTION OR SOMETHING THAT THE COURT HAS CREATED?

WHEN THE VACANCY OCCURS? >> IT IS LONG SETTLED LAW. SPECTOR VERSUS GLISSON ANNOUNCED THE TIME OF THE RESIGNATION IS

TENDERED AND ACCEPTED BY THE GOVERNOR AND CONSISTENT WITH 114 OF THE FLORIDA STATUTES WHICH IS RESIGNATION OCCURS WHEN THE

RESIGNATION TAKES PLACE. >> WHAT CASES WE TALKED ABOUT AN ACTUAL VACANCY? JUDGE FOSTER WHO COULDN'T SERVE

ANOTHER TERM HAS BEEN SITTING AND CONTINUE TO SIT UNTIL A COUPLE DAYS BEFORE. >> IN THE 1992 ADVISORY OPINION

INVOLVING JUDGE FULLER, MORE SPECIFICALLY 2006 ADVISORY OPINION THE SHERIFF IN JUDICIAL VACANCIES ADVISORY OPINION FOR

2006, INVOLVED A RESIGNATION TENDERED BEFORE THE QUALIFYING PERIOD AND EFFECTIVE AFTER THE QUALIFYING PERIOD AND IN THAT

CASE AS WELL THE COURT HELD TO ITS PRECEDENT THAT THE EFFECTIVE DATE OF THE VACANCY WHEN IT IS ACCEPTED RATHER THAN THE DATE IT

BECOMES EFFECTIVE. >> IN THAT CASE THERE WAS A TRUE -- HE WAS RESIGNING EFFECTIVE MAY 31ST SO THERE WAS A 7 MONTH

VACANCY. AND ACTUAL VACANCY. THE OTHER QUESTION I HAVE, I KNOW I STOPPED YOU AT THE

BEGINNING, IS THIS IDEA, I THINK IT CAME FROM ADVISORY OPINION. OF THE RESIGNATION BECOMES ACCEPTED BEFORE THE BEGINNING OF

THE QUALIFYING PERIOD, IT GOES BY APPOINTMENT. IT IS AFTER THE QUALIFYING PERIOD BY ELECTION AND I BELIEVE

THAT WAS AN ADVISORY OPINION, WHAT IS THE RATIONALE THAT THE COURT WOULD HAVE ENUNCIATED WHICH SEEMS TO BE A VERY

ARBITRARY DEADLINE WHEN YOU KNOW THERE ARE MONTHS AHEAD. AND SINCE WE ARE CONCERNED ABOUT THE ADMINISTRATION OF JUSTICE IF

THE CONSTITUTION DOESN'T SPEAK TO IT DOES THAT MAKE SENSE TO YOU? >> LET ME ANSWER YOUR QUESTIONS

AND TURN. THE LENGTH OF THE ACTUAL VACANCY, PICKING UP ON SOMETHING JUSTICE LAWSON MENTIONED IN THE

EARLIER QUESTIONING, AS PART OF ITS RATIONALE IN THESE CASES AS TO THE LENGTH OF THE ACTUAL VACANCY, SPECIFICALLY IN THE

2002 ADVISORY OPINION WHEN THIS COURT RETIRED JUDGE HARLEY ON THE LEON COUNTY COURT DURING THE QUALIFYING PERIOD THIS COURT

DETERMINED THE SEAT SHOULD BE FILLED BEFORE THE ELECTIONS PROCESS, NOTWITHSTANDING JUDGE HARLEY WAS INVOLUNTARILY RETIRED

EFFECTIVE AT MIDNIGHT THE SAME DAY RESULTING IN AN 8 MONTH ACTUAL VACANCY IN OFFICE. NOTWITHSTANDING THE 8 MONTH

ACTUAL VACANCY THIS COURT SAID THE ELECTION PROCESS SHOULD CONTINUE BECAUSE THE ELECTION PROCESS HAD BEGUN.

EMPLOYMENT HAPPENED IN CASES WITH 7 MONTH ACTUAL VACANCIES, ELECTIONS HAPPENED WITH 8 MONTH VACANCIES.

>> SOUNDS TO ME LIKE JURISPRUDENCE CREATED SOMETHING NOT VERY JURISPRUDENTIAL HE SOUND IS WHAT I'M SEEING HERE.

THAT IS MY POINT. WE HAVE AN OPPORTUNITY TO MAKE SURE GOING FORWARD THAT THE SYSTEM CAN'T BE MANIPULATED.

SEVERAL JUDGES IN THEIR HEART BELIEVE, OVER ELECTION BUT THE QUESTION IS VOTERS HAVE REJECTED THAT FOR TRIAL JUDGES AND

CREATED BY JURISPRUDENCE, UNINTENTIONAL WHOLE, WHERE THE SYSTEM CAN BE MANIPULATED. >> AS WE LAID OUT THE BRIEF THE

CONSTITUTION PROVIDES WHEN VACANCIES OCCUR IN OFFICE, VACANCIES ARE FILLED BY THE GOVERNOR AND THAT IS WHAT THE

CONSTITUTION SAYS. THE COURT IN THE 2002 ADVISORY OPINION IS EXCEPTION TO THAT. AND JUSTICE LEWIS DISSENTED FROM

THAT OPINION, THE ELECTION PROCESS, THAT LED US TO THIS AREA. THE POLICY RATIONALE, THAT WAS A

VACANCY AFTER THE QUALIFYING PERIOD. THE EVE OF AN ELECTION. UNDER THOSE CIRCUMSTANCES IT

DOESN'T MAKE SENSE TO A POINT TO NULLIFY AN ONGOING ELECTION. THE 2002 CASE THE VACANCY QUALIFYING IN THE ELECTION

PROCESS SHOULD CONTINUE. AND THE VACANCY OCCURRED THE QUALIFYING PERIOD TO THE VACANCY, APRIL RESIGNATION, AND

THERE WERE CANDIDATES WHO WANTED TO RUN FOR THAT OFFICE AND THIS COURT THAT THE CONSTITUTION REQUIRES VACANCIES TO BE FILLED

BY THE GOVERNOR AND QUALIFYING PERIOD HASN'T HAPPENED YET IN THE ELECTION PROCESS IS DONE AND THE 2008 OPINION VACANCY

OCCURRED DURING THE QUALIFYING PERIOD AND THEY SAID WE WON'T LOOK AT FACTS SPECIFIC TO EACH ELECTION CYCLE TO DETERMINE HOW

THE PROCESS SHOULD BE CARRIED OUT. WHEN DID THE VACANCY OCCUR? WAS IT BEFORE OR AFTER THE

BEGINNING OF THE STATUTORY QUALIFYING PERIOD? WE DON'T HAVE TO LOOK AT THE LENGTH OF THE VACANCY, SPECIFIC

NEEDS OF ANY TRIAL COURT, SUBJECTIVE MOTIVATIONS OF THE RETIRING JUDGE. WAS IT BEFORE OR AFTER THE

QUALIFYING? THERE IS AT LEAST ONE RATIONALE FOR THAT APPROACH BEING TAKEN. >> IS THERE A PROBLEM WITH THE

LANGUAGE THAT SAYS THE VACANCY OCCURS WHEN YOU SEAL A LETTER AS OPPOSED TO THE DATE THAT YOU INDICATED IN THAT LETTER, YOU

WERE ACTUALLY LEAVING, RESULTING IN A REAL VACANCY AS OPPOSED TO THEORETICAL? >> I DON'T THINK WE HAVE A

DISAGREEMENT WITH OUR FRIENDS AS TO THAT LINE OF PRECEDENT AND THAT HAS EXISTED SINCE SPECTOR VERSUS GLISSON AND IS CONSISTENT

WITH LANGUAGE OF ARTICLE 10 SECTION 3 IN CHAPTER 114 OF THE FLORIDA STATUTE AND WHAT THAT ALLOWS IS THE JUDICIAL

NOMINATING PROCESS TO BEGIN, TO RESULT IN NOMINATIONS AND APPOINTMENT FOR A SEAMLESS TRANSITION.

>> ON THE OTHER HAND, CIRCUIT AND COURT ACCOUNT ELECTIONS ARE DIFFERENT FROM THE APPELLATE PROCESS BUT IN AN APPELLATE

SITUATION, GENERALLY YOU GET, IF SOMEONE GETS TO THE END OF THEIR TERM SUCH AS JUDGE FOSTER WOULD HAVE AT THE END OF HIS AGING

OUT, THE PROCESS STARTS, THE CONSTITUTION REQUIRES AT LEAST 60 DAYS BEFORE THE ACTUAL VACANCY.

WHY ISN'T THAT JUST AS GOOD A PROCESS TO HAVE A CIRCUIT COURT SITUATION? >> I THINK THERE ARE DIFFERENT

POLICY ARGUMENTS WHAT A BETTER SYSTEM WAS. JUSTICE. THEY -- THE CLARIFYING AMENDMENT IS ONE WAY TO ADDRESS

THIS. AS A MATTER OF CURRENT PRECEDENT AND CURRENT CONSTITUTIONAL LANGUAGE I DON'T THINK THERE'S

ANY DISPUTE THE VACANCY OCCURRED BEFORE THE QUALIFYING PERIOD AND IN ANY SUCH CIRCUMSTANCE VACANCIES BEFORE CANDIDATE IS

QUALIFIED ARE FILLED BY THE APPOINTMENT PROCESS. >> WHAT IS THE EXECUTIVE BRANCH'S VIEW?

IF WE HAVE A CIRCUMSTANCE, THIS COURT WOULD SAY WE CREATED A LOW, JURISPRUDENCE THE TALKS, A THEORETICAL THING.

IT IS NOT A REAL THING. CERTAINLY YOU CAN'T STOP JUDGES OR OTHER OFFICERS FROM RESIDING. IT IS A PART OF WHAT HAPPENS.

THE CONSTITUTION DOES NOT PROVIDE FOR A YEAR'S WAIT TIME. IT IS NOT CONSTITUTIONALLY ENSHRINED.

IT IS SOMETHING WE ALLOWED. WHAT WOULD BE THE EXECUTIVE BRANCH'S VIEW IF A COURT WOULD SAY THE VACANCY, IT OCCURS, WHEN

IT IS TENDERED AND ACCEPTED AND INDIVIDUAL JUDGES DO NOT HAVE THE POWER TO SUBVERT THE WILL OF THE PEOPLE EXPRESSED IN THE

CONSTITUTION. IT IS NOT WHAT WE WANT OR WHAT US LAWYERS ONCE. IT IS WHAT THE CONSTITUTION SAYS

AND ALTHOUGH I MAY PREFER AS MANY DO A MERIT RETENTION SYSTEM WE DON'T HAVE IT FOR TRIAL JUDGES.

WHAT WOULD BE THE EXECUTIVE'S RESPONSE TO AN OPINION OR THOUGHT OR AN ARGUMENT THAT WOULD SAY WE SHOULD NOT LET

JUDGES OR POLITICIANS MANIPULATE WHAT THE CONSTITUTION CLEARLY SET FORTH, THAT IT OCCURS WHEN TENDERED AND ACCEPTED.

>> TWO RESPONSES TO THAT. ONE MORE ON THE LAW AND ONE FROM PRACTICAL EXPERIENCE. ON THE LAW THE CONSTITUTION DOES

PROVIDE A MERIT SELECTION PROCESS TO FILL VACANCIES. ARTICLE 5 SECTION 11. THAT IS THE CIRCUMSTANCE HERE,

TO FILL A VACANCY IN OFFICE FOR A LIMITED TERM FOLLOWED BY ELECTION FOR A FULL TERM. THE MORE PRACTICAL CONSEQUENCES,

WE HAVE NOT SEEN ANY FROM MISTER DAVID P. TROTTI V. RICK SCOTT, GOVERNOR, ET AL. ABOUT WHAT WILL HE IS ASKING THE COURT TO ADOPT

THAT WOULD NOT ALLOW A JUDGE TO RESIGN IN A WAY THAT WOULD ENSURE AN APPOINTMENT OR AN ELECTION OF HIS OR HER

SUCCESSOR. IF THIS COURT WERE TO SAY -- >> DOESN'T MEAN WE ARE TALKING IN TERMS OF WHAT IS THEORETICAL.

IT IS NOT REALLY A VACANCY. THE LETTER SAYS I'M NOT GOING TO LEAVE UNTIL THE DAY BEFORE THE TERM EXPIRES.

>> IF THIS COURT WERE TO SAY THE VACANCY CANNOT BE BEFORE THE GENERAL ELECTION. >> YOU CAN'T FIX IT IF YOU WANT

TO RESIGN, GO AHEAD AND RESIGN. THE TERMS OF THE RESIGNATION BECOME A FACTOR AS THE CONSTITUTION SAYS, WHEN ACCEPTED

BY THE EXECUTIVE. >> THAT WAS SOMETHING MISTER DAVID P. TROTTI V. RICK SCOTT, GOVERNOR, ET AL. SUGGESTED ON

PAGE 30 OF HIS BRIEF, RESIGNATIONS EFFECTIVE IN THE FUTURE ARE UNCONSTITUTIONAL, THAT WOULD BE A DRAMATIC

DEPARTURE FROM THIS COURT'S PRECEDENT. >> I DON'T KNOW. WHAT PROHIBITS THAT?

>> I DON'T BELIEVE IT DOES, I DON'T BELIEVE ANYTHING IN THE CONSTITUTION DOES THAT. THE PETITIONER SUGGESTED THAT ON

PAGE 30 OF HIS BRIEF THAT THE COURT MIGHT DECIDE RESIGNATIONS EFFECTIVE TOO FAR IN THE FUTURE ARE UNCONSTITUTIONAL BUT THOSE

HAVE HAPPENED BEFORE. >> IT WOULD BE EFFECTIVE AS THE DAY WE GET IT. TO ME IT IS AN AFFRONT TO THE

PEOPLE OF FLORIDA TO HAVE JUDGES THAT CAN MANIPULATE THE HEART OF WHO WE ARE AS A DEMOCRACY AND I THINK WITH THE TRIAL JUDGE HAD

TO SAY IS THAT IS WHAT THIS IS DOING AND I LOOKING TO SEE IF THERE IS NOT SOME OTHER LEGALLY SOUND BETTER WAY.

>> JUST SO I CAN UNDERSTAND, JUSTICE LEWIS, YOUR SUGGESTION IS A JUDGE WANTS TO RESIGN, THAT RESIGNATION MUST BE EFFECTIVE

IMMEDIATELY, CANNOT BE DELAYED. IF THE RESIGNATION OF JUDGE FOSTER HAPPENED IMMEDIATELY IN APRIL, THEN I DON'T THINK THERE

IS ANY QUESTION THAT VACANCY WOULD HAVE BEEN FILLED BY APPOINTMENT. >> MY PROBLEM IS THE CHARADE

BEING PLAYED, HE'S NOT REALLY RESIGNING. >> WHAT THE PROBLEM WITH SUCH A COOL BE IT WOULD MAKE EVERY

RESIGNATION EFFECTIVE IMMEDIATELY, YOU TURN IN THE RESIGNATION AS IT IS EFFECTIVE, THAT WOULD ESSENTIALLY GUARANTEE

A TWO OR THREE MONTHS PHYSICAL VACANCY BEFORE THE PROCESS, THE MERIT SELECTION PROCESS CAN DO ITS WORK.

>> ABSOLUTELY RIGHT, A PRACTICAL MATTER AND IT COULD BE A 5 OR 6 MONTHS VACANCY. >> WE HAVE SENIOR JUDGES IN THE

LEGISLATURE IS PROVIDING THOSE AND THERE ARE HUNDREDS OF SENIOR JUDGES AROUND THE STATE, THERE IS NOT A SENIOR JUDGE -- WHY NOT

PLUG THOSE IN UNTIL YOU NEED? >> THAT WOULD BE CONTRARY TO A NUMBER OF OPINION SUGGESTING JUDGES SHOULD RESIGN EFFECTIVE

IN THE FUTURE TO ALLOW FOR A SEAMLESS TRANSITION. >> NOT SURE THERE IS A REASON, THEY ARE OVERWORKED OR CAN'T DO

THIS. AFTER 20 YEARS, WATCHING WHAT IS HAPPENING, WHAT IS GOING ON WITH THE TRIAL COURT SYSTEM, I CAN'T

SEE, AND MORE THAN ADEQUATELY APPROVAL SENIOR JUDGES THAT COME THROUGH CONFERENCES. AND PAGES AND PAGES OF THEM.

OUR CONCERN AS PEOPLE THINK THIS IS A LAUGHABLE SITUATION. ONLY LAWYERS BUT THEY VACANCY WHEN THE LETTER COMES IN BUT YOU

DON'T HAVE A VACANCY UNTIL 10 MONTHS LATER BECAUSE ONE JUDGE DECIDED THAT IS WHAT HE OR SHE IS GOING TO DO.

>> IF THIS COURT WERE TO SAY JUDGE FOSTER'S RESIGNATION IS EFFECTIVE IMMEDIATELY AS TO APRIL 23RD WHEN IT WAS ACCEPTED

BY GOVERNOR SCOTT THE RESULT OF THIS CASE WOULD BE ON OTHER GROUNDS IN THE PROCESS? >> TRYING TO FIND IN THE FLORIDA

CONSTITUTION. THAT IS WHAT WE ARE TALKING ABOUT. >> I DON'T KNOW.

IS IT POSSIBLE FOR SOMEONE TO WITHDRAW THE RESIGNATION? >> I CHANGED MY MIND, I STILL HAVE 6 MONTHS.

>> UNDER THE COURT'S PRECEDENT IT IS POSSIBLE TO WITHDRAW A RESIGNATION UNTIL THE POINT IT HAS BEEN ACCEPTED BY THE

GOVERNOR. >> HOW DOES THE GOVERNOR ACCEPT THE RESIGNATION? BY CONVENING THE JUDICIAL

NOMINATING COMMISSION, I ACCEPT YOUR LETTER OF RESIGNATION? >> IT IS A WRITTEN RESIGNATION AND SEPARATE CORRESPONDENCE

ASKING THE JUDICIAL NOMINATING COMMISSION. >> THE GOVERNOR CONVENES AND IF NOMINATED.

>> INSPECTOR VERSUS GLISTEN AND JUSTICE URBAN'S RESIGNATION, AND IT IS IRREVOCABLE. AND IT IS PROPERLY DEEMED

IRREVOCABLE. >> ON THAT, A JUDICIAL CANDIDATE NOMINATED, AS A COURT JUDGE. IF WE AGREE, AND WHAT JUSTICE

LEWIS SUGGESTED, GOING WITH THE FIRST DISTRICT, WOULD HAVE TO RUN FOR ELECTION IN 2020. >> IF THE GOVERNOR ANNOUNCED HIS

INTENT TO APPOINT COUNTY JUDGE LESTER BEST TO PROCEED. >> FOR A YEAR, DOING THE MATH. >> UNTIL THE NEXT GENERAL

ELECTION MORE THAN A YEAR, AND AUGUST PRESUMABLY. >> WE UNDERSTAND, THAT APPEARS TO OCCUR FOR MANIPULATION,

MOTIVATED CONTENTIONS OCCUR IN EVEN NUMBERED YEARS. WHEN THE VACANCY OCCURS IN AN ODD NUMBER OF YEARS, HAVE TO

EXPLAIN WHY MERIT SELECTION AND OTHERS, THERE IS NO QUESTION THOSE SEATS ARE FILLED BY MERIT SELECTION.

IS THAT CORRECT? >> THAT IS RIGHT. THIS SEEMS TO COME UP IN AN EVEN NUMBER OF YEARS.

>> IN CASES RECENTLY WHERE EVERYBODY CAN'T EVEN RUN AGAIN, THESE SITUATIONS HAVE COME UP AND UNQUALIFIED, BUT

INTENTIONALLY LEAVING TWO OR THREE DAYS BEFORE THE END OF THE TERM. WE HAVEN'T HAD THAT.

>> THE CASES IN RECENT YEARS ARE ALL THAT SITUATION. >> WE HAVE JUDGES, IN THE END OF DECEMBER AFTER THE CAPER.

IN THOSE CASES THE ELECTION PROCESS. >> GOES BACK TO WHAT JUSTICE LEWIS DISSENTED TO SAY WHERE DO

WE COME UP WITH THAT ONE SO WE PRINT ANOTHER ARBITRARY DISTINCTION. >> WHAT WE WOULD ASK THIS COURT

TO SAY CONSISTENT WITH THE 2006 ADVISORY OPINION, DO ANY ATTORNEYS SUCH AS MISTER PARIENTE 9 WANT TO RUN FOR THIS

OFFICE, THE SCENE WILL BE UP IN TWO YEARS. IT IS A LIMITED INITIAL APPOINTMENT AND THEY COULD RUN

FOR THAT SEAT. MY TIME IS UP. >> I WENT TO GIVE AN EXTRA MINUTE.

>> THANK YOU VERY MUCH. JUSTICE LEWIS'S EARLIER POINT ABOUT THE ISSUES THAT CHANGED SINCE THEN.

THE MOST IMPORTANT DIFFERENCE BETWEEN NOW INSPECTOR VERSUS GLISTEN LEGALLY IS THE 1996 AMENDMENT TO THE CONSTITUTION,

SPECTOR VERSUS GLISTEN HAD IS A CENTRAL PREMISE THAT PEOPLE WANT VACANCIES FILLED THROUGH THE ELECTION PROCESS AT THE EARLIEST

OPPORTUNITY BY EXTENDING THE INITIAL APPOINTED TERM TO TWO YEARS BEYOND THE CLOSEST ELECTION.

PEOPLE UNDERMINED THAT PREMISE AND THAT IS ANOTHER REASON SPECTOR SHOULD BE ILLEGAL. >> ANOTHER QUESTION.

AM I CORRECT THAT THE ISSUES WE HAVE BEEN DISCUSSING WERE DECIDED IN THE 2014 CASE. >> YES.

>> AM I CORRECT THE PARTIES IN 2014 SOUGHT REVIEW AND IT WAS NOT GRANTED? >> CORRECT.

>> WHAT WAS THE LEGAL ISSUE IN THE CASE THAT WE ARE CURRENTLY HERE ON TODAY? >> WE BELIEVE LEGAL ISSUES AND

FACTUAL ISSUES ARE LARGELY INDISTINGUISHABLE IN THE PARIENTE 9 CASE. >> WASN'T THE ISSUE WHETHER THE

TRIAL JUDGE AIRED IN A PRIMARY INJUNCTION? >> THE VEHICLE WAS DIFFERENT IN A FEW CASES.

IN 2014 CASE MISTER DAVID P. TROTTI V. RICK SCOTT, GOVERNOR, ET AL. SUBJECTED THE PETITION FOR THE FIRST DISTRICT COURT OF

APPEAL, IN THIS CASE A DECLARATORY JUDGMENT WAS SOUGHT AND GRANTED BY THE TRIAL COURT AND REVERSED BY THE FIRST

DISTRICT COURT OF APPEALS. >> MAYBE I MISS READING IT BUT I READ THE CASE AS SIMPLY HOLDING BECAUSE OF THE 2014 OPINION

MISTER DAVID P. TROTTI V. RICK SCOTT, GOVERNOR, ET AL. COULD NOT SHOW SUBSTANTIAL LIKELIHOOD OF SUCCESS ON THE MERITS AND

THEREFORE THE INJUNCTION WAS INCORRECT SO THE COURT DID NOT READ DECIDE ANY OF THE ISSUES. THEY JUST DETERMINED THIS CASE,

THE HOLDING WAS THE TRIAL COURT WAS BOUND BY THAT CASE. IS THAT AN INACCURATE SUMMARY OF THE CASE?

>> IT IS ACCURATE AND THE VIEW EXPRESSED IN OUR JURISDICTION. WE ASK THIS COURT TO DISCORD JURISDICTION IS IMPROVISED AND

GRANTED OR OF THE DISTRICT DECISION. >> TO GO TO A POINT COUNSEL MADE NEAR THE END ABOUT THE 96

AMENDMENT, ALL IT DID WAS LENGTHEN TERM OF AN INTERIM APPOINTMENT BUT DIDN'T MAKE IT MORE PERMANENT OR CHANGE THE

RELATIONSHIP BETWEEN ARTICLE 5 SECTION 10 OR ARTICLE 5 SECTION 11 AND I WOULD LIKE TO READ YOU ONE LINE, CITING 2009, LONG

AFTER THE 2006 AMENDMENT, THE NOMINATING COMMISSION PROCESS IS A RESTRAINT ON THE GOVERNOR, NOT A NEW PROCESS OF REMOVING FROM

THE PEOPLE THEIR TRADITIONAL RIGHT TO ELECT THEIR JUDGES. GOES ON TO QUOTE AT LENGTH SPECTRUM VERSUS GLISTEN.

EVERY MEMBER OF THE COURT FIND THAT OPINION. LET ME MAKE ANOTHER POINT. IF I COULD FOCUS IN A LITTLE BIT

ON THE DIFFICULTY WE ARE HAVING HERE. I DON'T THINK WE DISAGREE ABOUT THE BODY OF LAW THAT SAYS A

VACANCY IS CREATED IF THE RESIGNATION OCCURS BEFORE QUALIFYING. WHAT IS A VACANCY?

IS THIS A VACANCY? THE TRIAL JUDGE SAID THIS WAS AN ARTIFICIAL VACANCY. THAT IS A GOOD WAY TO PUT IT.

MY QUESTION, WOULD YOU BE SATISFIED IF SOMEBODY RESIGNED 15 MINUTES BEFORE MIDNIGHT ON THE LAST DAY OF HIS OR HER TERM.

NO WORK IS BEING DONE. THE COURTHOUSE IS NOT EVEN OPEN BUT WE HAVE TO BLINDLY AND REFLEXIVELY FOLLOW A RULE THAT

SAYS YOU KNOW THE JUDGE SUBMITTED RESIGNATION BEFORE THE QUALIFYING AND THERE ISN'T ANY REAL DIFFERENCE BETWEEN THAT

EXAMPLE AND WHAT OCCURRED HERE. ISN'T ANY REAL DIFFERENCE BETWEEN THAT AND SPECTOR. SPECTOR DIDN'T TURN ON THE FACT

THE JUSTICE URBAN RESIGNED IN THE LAST DAY OR THE DAY BEFORE OR THE WEEK BEFORE. THE WHOLE POINT IS THERE WAS

INTERVENING ELECTION AND HAVE CITIZENS HAVE A RIGHT TO ELECT THEIR SUPREME COURT JUSTICE IN THE ELECTION.

>> WOULD YOU ALSO AGREE THAT THE ISSUES WE ARE TALKING ABOUT WERE DECIDED BY THE PEOPLE IN 2014 IN THE FIRST DAVID P. TROTTI V.

RICK SCOTT, GOVERNOR, ET AL. CASE? >> THEY WERE BUT I DISAGREE -- >> WOULD YOU AGREE THAT THE

ISSUE ON APPEAL STATED IN THE OPINION WE ARE HERE ON IS THE TRIAL COURT ERRED IN GRANTING AN INJUNCTION ON THE BASIS THAT

THERE WAS NO SUBSTANTIAL LIKELIHOOD OF SUCCESS. IS THAT THE WAY THE COURT FRAMED THE ISSUE?

>> THE TRIAL COURT FULLY REACHED THE MERITS OF THE ISSUE AND -- >> TALKING ABOUT THE APPELLATE. >> YOUR QUESTIONING ME ABOUT

JURISDICTION. I WILL RESPECT THE FACT THAT JURISDICTION IS ALWAYS OPEN IN THIS AND NO QUESTION ABOUT IT.

>> AS MUCH AS WE WANT TO DECIDE A CASE -- >> IN THIS CASE THE FIRST DISTRICT MADE ITS DECISION IN

THIS OPINION, THE 18 OPINION BASED ON THE LANGUAGE OF THE CONSTITUTION, THE FIRST LINE OF THE STATE SUMMARY OF THE

ARGUMENT IS THIS CASE TURNS ON AND INTERPRETATION OF THE STATE CONSTITUTION SO THE COURT, I THINK TO ANSWER YOUR QUESTION,

THE COURT DENIED AN INJUNCTION BECAUSE IT DIDN'T AGREE WITH US ON THE MERITS. THE COURT REACHED THE MERITS ALL

OVER. >> ONE OTHER QUESTION. YOU JUST SAID IF THERE IS AN INTERVENING ELECTION THAT MAKES

THE DIFFERENCE. IF YOU ARE -- IT SAID IF I AM RESIGNING OCTOBER 31, 2018, SIX DAYS BEFORE THE ELECTION, THIS

WOULD BE AN APPOINTED SEAT. YOU AGREE TO THAT. >> YES I WOULD. >> IN YOUR MIND IT ALL TURNS ON

WHETHER OR NOT THERE IS IN FACT AN ELECTION BEFORE THE DATE OF THE RESIGNATION. >> YES AND THAT IS NOT JUST IN

MY MIND BUT WHAT SPECTOR SAYS. THE ONLY REASON TO MAKE AN INTERIM APPOINTMENT IS EMERGENCE OF PUBLIC BUSINESS.

FOUR DAYS, IS IT GOING TO SAY WE APPOINT SOMEBODY FOR FOUR DAYS? I AM OVER -- SPECTOR SAYS, AND TO THE CONFERENCE ROOM AND

HAVING TROUBLE WITH THAT I SUGGEST TO YOU THAT THE ANSWER IS THIS SHOULD BE AN ELECTION AND FLUSH THE DECISION OF THE

DISTRICT COURT. >> THANK YOU FOR YOUR ARGUMENTS.

People Finding Secret Hidden Rooms In Their Homes ! - Duration: 10:42.

Imagine finding a secret room in your house. Well a lot of people do and we're gonna look at those people

Let's go exploring when we first moved in. I like the curtains by the way

It's better than all the way and I looked out the window

and

and she's been scooting me as you can see it's a normal yard with a screen and

Roof, and they have a going on. What is that roof right there? Why is there a brief?

Like there's all the way. Yeah. I'm actually kind of curious. I love this as it came over here, okay

But I popped a hole in the wall, okay

But I don't understand why would somebody make a room and then cover it up by a wall

What are they trying to hide there better be treasure in this video or I'm gonna I'm gonna be mad

Okay

Little

Secret room he made a single room for his son best dad ever

That is so cool

I've always wanted like a secret room like a secret hideout or like a tree house and I never got either

Okay, maybe one day I should build one and be cool. Okay. Let's see. What's in here

Best dad ever. Wow, this is amazing. I've never been so jealous in my life

I'm happy for the kid, but I also want one of these

That may be so excited to see the rest of them so this guy's giving us a tour of his new apartment until he finds

Something he didn't expect here's the apartments I moved into last week. Okay, nice apartment

Do it all pretty nice rent was pretty cheap

So I moved into that even viewing the place we moved in without even viewing the place. That is some risky business

So you put a lot of faith in that I guess he said the rent was cheap

He's like I don't even care like it. Was that cheap. I couldn't just move into somewhere. What if there was

Or what if there was?

Ghosts or what if there's a secret dungeon 3d old building really high ceilings

Okay, like a 19th century monastery in the middle of England. So you come on through here guys. It's mirrors everywhere

Hello, because mirrors make a place look bigger

I like Marissa Mayer is like let a lot of life into place to like it makes it place a bigger like I'm a I'm

A fan of having mirrors Edward and then also you got to check out your alpha and you're like who dressed me today?

Like what am I wearing or you can be like outfit complete closet space?

All the usual stuff. Okay. Got a pretty steep staircase leading up to the bedroom

The bedroom is on a mezzanine. It was pretty small. I was pretty disappointed with the bedroom, honestly

I'm okay with staircases, but leading to a bedroom being half asleep and stairs. Do not mix like, you know many times

I'm going to tumble down that low stairs

No, I need to be fully awake before I tackle stairs pretty small can't even stand up book. Kick

It's like a loft. I kind of like it. It feels like I'm really weird mirrors on a roof, but I guess there's groan

I don't like doesn't need a bunk bed in his life. It's pretty interesting. Watch out, you know fall out of bed

And kill yourself then what is that?

Stephanie handle it looks like a handle dude. So I figured you know bit of underfloor storage

Let's lift it up

Users beware guys, I'm pretty deep

- I had enough torch on top - camera see he's thinking he's thinking you I want to see this. I'm expecting treasure

Okay honest, it looks a little creepy

What I did this alone No, call me a scaredy-cat all you want I am

Just owns an old brickwork, this is so cool

And kind of discussing this room on the bright side underneath my apartment

Is this safe like what if this Colossus?

See CFC, okay

Sure. I don't know that means looks like this window has been pretty tough

Well, they just spew we don't somebody used to live down here

Break seats. Hey, you know what? I think he should do guys

I think he should like remodel it, you know, like make it all clean

Like put nice walls up and like have like a secret hideaway and then he gets so much more living space

Like his square footage is doubled. Hello. Oh, it's just a doorknob. I thought it was a creepy doll

A lot of space out here. This is literally bigger than his apartment, dude

You got to make this all your apartment got a do it

I got a next one guys that one lived in our home for 28 years what 8 years recently we discovered

We love our home, but recently we discovered a little bit of a problem. What what's the problem? We don't like problems

Here it has been you know, we do with problems

I'm joking. Whoa. Am I in our back porch? That's a Ford put flagstone, dude

Killing me. It started up here but a month ago. I was a hole just starting to appear out of nowhere and we

Worked it took the flagstone off

And this is what we have found

Okay this hole

Okay, okay. Okay, okay

That's scary that's dangerous you could fall down there

that's

cavern

What that's 16 feet deep. What could you even do with that? Like nothing. This is where I keep on my exploit guys

I'm joking by though. I mean I say these things please don't take them seriously

I would never store my ex-boyfriends in a in a dish

I always try to be saying a good recipe Oh, we figure it was a well from

6070 years ago

well, we're not sure that's the craziest thing we've ever seen that probably was a well that does the only thing that makes sense like

Why would you need anything? This deep wells scare me because scary movies we uncovered it

And it's gonna be filled with what probably blink dark. I really can be fastened like this

I can't you make something cool out of it. I think it's such a waste not to

It's also dangerous not to always not assume. What's in your backyard. All right, he's like really annoyed

I didn't like more like intrigued me

hmm Oh Leon 7 News secret passages hidden wires secret passageways hidden buyers

Matches this Denver Hall booby trap perhaps by a local mobster. These people's house has been booby-trapped

Doing a very simple home remodeling project damn first. We couldn't trust people now. We can't even trust our own houses. What is

white when Alan takes us inside a Denver crime families secret hideaway Oh,

Like you literally moved into somebody secret hideaway. These people are living in a movie

Okay, like this can't be real life, but it is on the outside

It may look like any other historic home in this North Denver neighborhood

This is the basement. But inside Wow, the secrets of the gangster's paradise

Here goes nothing are flying revealed. There was a

Full wall here when Matt Feeny bought his 1891 Victorian on Osage Street

It needed some TLC. So he started to knock out the walls and the walls

Started to talk. So house. We're knocking it out

Hitting it right here. We're smelling matches as if they've you know being constantly lit Feeny says buried in plaster

He discovered a row of matches. That's so dangerous. They over set off the traps

it was got back sack by their own house and it led to

These canvas packets taped up against the wall matches fuses

Newspapers Feeny feels his new residence was rigged. So you think this house was booby-trapped I do

I think that might have just been a way

for them to

Quickly make a distraction. He hasn't found any evidence of foul play only photos and letters and a bottle of poison

That's cool. If only these walls could really talk once this man found a bottle of poison

Man, oh man. Oh man this got real real quick. That's a big hole in the ground. He's walking so close to it

Dude, be careful

My car parts on their front front driveway. I went to reverse out as I did

Crumbling

Front tire imagine this whole car just like fell through like Schramm Karen on reverse now and all of a sudden the car jolted forward

And I've got some real resistance. So I really put my foot down reversed out

Yeah, then go out the car and checked and this hole had just opened up in the front garden

Well, isn't that terrifying some of the slaps out of the way in investigate? We actually found that

Hey guys, it's ready to go down the ladder cuz I am so yeah, the actual shelter itself is 10 feet down so

It was completely filled up with mud to about here

But we've we've managed to dig it down 5 5 feet so far you can see five of the wrongs

this dude is

Ready for the zombie apocalypse like ready like no one else is like I need a shelter

You could never be too prepared for life. So this is the actual shelter itself

Um, obviously the main room where the ladder comes down

But then this is the actual part I guess where they used to go when the bombs were dropping so

When the sirens went off they'd run down the ladder into the safe room down there

You can see the height of it. There is 10 feet down

So that's how low I need to get this room, but let's get in there. I'm not even joking

He need to stop that up with food like hand food

Obviously because that lasts forever any stock put up with canned food and then if there's ever a zombie apocalypse

We know where to go. Okay. I hope here's enough room for odd. Ozzie Landers. Anyways, guys. I hope you enjoyed this video

I love you guys so much

SCU Law: Charney Hall Dedication - Duration: 2:02.

(upbeat music)

- [Lisa] Good morning.

I am so excited to celebrate the dedication of

the Howard S. And Alida S. Charney Hall of Law with you.

As Howard has said,

this gorgeous building is just the starting point

as the School of Law realizes its vision

to become a premier and distinctive law- Jesuit law school,

that produces excellent, ethical leaders

at the complex intersection of

law, technology, business, justice, and ethics.

(upbeat music)

- [Michael] Right now, the Jesuits are called

to be on the frontiers of society.

And when we think about Silicon Valley,

we think of the frontiers of the digital age,

the expanding reach of bioengineering,

the unfolding possibility of nanotechnology.

This is the place where Jesuit institutions should be.

This is the place where Jesuit law schools should be,

because of the values, the ethics,

and the commitment to justice

that is part and parcel of the whole law school experience.

(upbeat music)

- But if, as attorneys and leaders,

you can help restore respect for the law,

restore that American Dream,

strengthen our democracy,

and most of all, protect our values,

then that, ladies and gentlemen,

will be the greatest legacy of Charney Hall.

- [Howard] So I thought I'd get all of you here today

in support of this new building at Santa Clara Law.

And I hope that over the next five years, or ten years,

or however long it takes,

we can work together to make this school

an ever-improving forum for greatness.

(soft upbeat music)

Should You Write a Catchy Title for Your Scientific Paper? - Duration: 8:16.

Hi.

I'm Karen McKee, retired scientist and author with another video about scientific writing.

Did you know that there is a group of Swedish scientists who have a running bet as to who

can publish the most papers before retirement with titles containing Bob Dylan quotes?

The paper that kicked off the contest was this one published in Nature Medicine in 1997.

"Nitric oxide and inflammation: the answer is blowing in the wind"

More papers with Dylan-inspired titles followed.

Are catchy titles like this a good idea?

In this video, I'll address this question and talk more broadly about what goes into

a good title for a scientific paper.

[music]

Successful authors put a lot of thought into writing their titles.

This is because the title of a paper is the single most important factor determining how

many people will find and eventually read that paper.

If a title doesn't sound interesting or relevant, people will pass the paper by.

On the other hand, a title that is thoughtfully crafted will attract readers.

A good title will also help convince a journal editor that the paper is worth considering.

But how do you come up with an effective and compelling title?

Well, there are a number of dos and don'ts when writing your title.

One admonition is to avoid unnecessary phrases such as "a study of" or "an investigation of"

Such phrases, which are more common in older papers, usually do nothing more than add to

the length of the title.

Today, journals usually limit the number of words or characters used in a title, so it

makes sense to omit unnecessary words.

You also want to avoid jargon, acronyms, and abbreviations in the title because only a

handful of experts will understand what these mean, as in this hypothetical example.

Although a few experts will understand that the acronym ADH stands for the enzyme alcohol

dehydrogenase, many potential readers will not.

Another mistake is to write a title that is too broad and does not convey what the paper found

For example, a title that just states the broad topic of the research:

Response of coastal wetlands to sea-level rise

Is this study about all coastal wetlands?

In all geographic locations?

Unless it's a review paper, probably not.

More importantly, this hypothetical title does not reveal what the study found.

Here is a title from one of my published papers:

Someone reading just the title knows that we specifically studied mangroves, a type

of coastal wetland, and conducted the work in the Caribbean Region.

The title also explains the key finding of the paper, which is that these mangroves adjust

their soil elevations in relation to sea level through biological, rather than just physical processes.

In other words, our findings were novel and of interest to others.

But what biological processes?

Exactly where does this adjustment take place?

You have to read the paper to find out.

That's what you want to do with your title.

Capture the reader's attention and provoke them to read your paper.

Another point that some experts mention is that you should avoid the use of question

marks, colons and hyphens in a title.

In general, it is better to state a clear finding instead of posing a question.

And use of colons or hyphens often means the title is too long.

However, such punctuation marks may not always be problematic.

One of my most highly cited papers has a question mark and a hyphen in the title.

Use of a question mark might be appropriate, for example, if your study's findings provided

evidence for a mechanism but could not demonstrate it conclusively.

In this study, we had strong but circumstantial evidence for the role of drought in causing

dieback of salt marshes.

The question mark acknowledges that we did not find the smoking gun, but did identify

a strong suspect.

But if you have a clear outcome, go with a declarative statement that conveys your key

finding.

Another common admonition is to avoid overly long titles with too much detail.

Some studies have shown that papers with short titles receive more citations than ones with

longer titles.

Papers with shorter titles may be easier to read and understand and, hence, attract more

readers.

It's also possible that authors of highly cited papers tend to craft more concise titles

or publish in journals restricting title length.

My recommendation is that you should not be aiming for a title with a specific word count,

but one that best fits your paper and that contains important keywords.

The reason you want to pay attention to keywords in titling your paper is because search engines

use the words in a document's title to assign its ranking in a search.

For example, here is the working title of a review paper I coauthored:

"The relative role of mangrove vegetation in maintenance of soil elevations within the

intertidal habitat"

Unless this is your field, it's unlikely that this title will convince you to download and

read this paper.

More importantly, that title lacks an important key phrase, which is sea level rise.

Here is the final title of our paper:

"How mangrove forests adjust to rising sea level"

This title is more attractive and shorter than the original and contains several search

terms that people are likely to use to find information on the topic of our paper.

OK.

Let's return to the topic of catchy titles and if they are a good idea.

Apparently, there are hundreds of scientific papers with allusions to song lyrics and literature.

Besides Dylan, Shakespeare, Lewis Carroll, and Star Trek are favorite sources of inspiration,

according to this study.

While catchy titles may sound clever or amusing, they probably shouldn't be used for a typical

scientific paper.

You've already heard the reasons why.

One reason is that not everyone will get the Bob Dylan quote or other saying you might

use in the title.

Another reason is that the extra words add to the title length.

The catchy title may not clearly convey the key finding of the paper

And finally, the catchy title often includes words that will not help readers find your

paper in an online search.

In the end, your goal in crafting a title for your paper is to condense your paper into

a single, brief statement that sends a clear message and simultaneously attracts readers.

To see how to distill your message down to a single sentence that can be used as a title,

see the video mentioned in the description.

Also, I've included some references to articles about titles of scientific articles at the

end of this video and in the description below the video.

I hope you find this information useful when you are writing your next scientific paper.

And don't forget to like my video if you found this helpful.

Would you press the button? - Duration: 4:09.

Okay. Are we rolling? Are we rolling?

There's a red light on the screen.

Am I rolling? Okay, forget this, Charlie.

Give me the-- give me the camera, Charlie!

Charlie, give me the camera. You're not filming--

Hey, guys. Want to toss in a quick disclaimer

to say a huge shout out to the sponsor of this video,

which is YouTube Originals and the show "Origin."

Hopefully you guys enjoy this video

and, uh, I'll see you in the next frame,

really, to be honest. All right, bye!

All right. What's up, everybody?

I just went through a very unique experience, to say the least.

If you guys are watching this video,

make sure you go over to my YouTube channel first

to see the first half of this.

It should actually be in the description down below.

There'll be a link to the first part.

I just opened this box from "Origin."

There was a flashlight, and a very powerful flashlight, at that point.

I got a bag of dirt.

And I got this nasty ball of ooze

which is now covered in paper.

We're gonna make sure we start with the letter this time.

The second letter, actually. What is it doing?

The last item in the box is...

( suspenseful music )

- Boom! A button. - ( explosion )

It is a golden button.

In front of us, we have a button.

This was the last piece of the box.

It is a random golden button,

and a letter, titled "The Button."

It says, "The Button." ( chuckle )

"Please watch USB file two." Where is that USB at?

I'm gonna watch that before we continue.

I'll be right back.

I'll just put it on the screen,

whatever I'm seeing right now.

This is a big file, man.

This is almost a gig.

It's a clip from the show

that I think has a button in it.

Hey! What do you think this does?

There's the button, guys.

It looks like something you would press in an emergency.

We only know if we try.

Wait. We have no idea what that does.

Yeah, but we're stuck in fucking no man's land.

The crew aren't coming. I say we push it.

Can we pause there for a second?

Can we take in the fact that Tom Felton just swore?

That hit me right in the childhood right there.

I'm not sure about this.

All right, all in favor.

Yeah.

That's four against four. I think we should wait.

- ( gasps ) - ( panting )

What the hell's going on?

- Jesus Christ! Go, go, go, go! - Climb!

Oh, you-- no! That's it?

Okay, let me finish reading this.

This is actually kind of fun.

"In front of you is a mysterious button.

Much like the group stuck on the ship,

you are faced with the challenge of deciding

to push the button, which opens a door.

Is there help on the other side?

Or is there danger?

Do you risk everybody's life,

or potentially save them?

The choice is yours.

Choose wisely, 'Origin.'"

In the scenario, guys, stuck on a ship,

you have no idea what to do or where to go,

but there's a button. I'm gonna be honest with you.

I think-- I think I'd push--

Ooh. Clearly, it looks like it was a bad idea.

First, what's gonna happen when I push this button?

Is it actually gonna open up a door somewhere?

Would I push a button if I was in that situation?

If there was a window of some kind,

I would try to look through just to see what's

on the other side of the door, obviously.

I think everybody would try that.

If there's no window,

I'm gonna go ahead and say,

yes, I would hit the button.

( alarms blaring )

You're stuck on a ship, there's nobody around,

you have nothing to lose at this point.

You're floating in deep space. What else do you have to lose?

You need to get off the ship, you need to progress somehow,

so if there's a button, you don't know what it does,

I would push it as well.

I'm with these guys, I would push it.

( alarms blaring )

100%.

100%, I would push the button.

And for anybody out there that's challenging me,

I wanna hear your logic.

If there's something on the other side

that's gonna try and kill you,

well, there's eight of you to fight it off.

Thank you so much to "Origin" for sending me this package,

and also for hosting me on their YouTube channel.

I absolutely, absolutely love unboxing random boxes like this,

so 100% I'll be watching "Origin" once it comes out.

Thank you guys so much for watching.

You can check out my stuff on my YouTube channel,

the @danocracy.

There'll be a link in the description down below.

And I hope in the fall, which is coming up soon--

actually are we in-- no, we're not in the fall yet.

When the fall arrives, hopefully we can chat

and figure what goes on in the series, so, yeah.

Thank you guys so much for watching.

I'll see you guys in my next video.

See you guys later.

[♪ INTRO]

Despite the fact that we've been sending humans into space consistently

for over half a century, space travel remains super dangerous.

I mean, you're getting a ride from some very powerful and very controlled explosions.

And we were reminded of that danger last week, when a scheduled launch of the Soyuz rocket

to the International Space Station had to be aborted mid-flight.

Luckily, astronaut Nick Hague and cosmonaut Alexey Ovchinin are safe and sound back on Earth.

But now we have to figure out exactly what went wrong before anyone else can go,

which threatens ISS operations.

While there have been some upgrades made over the years, the Russian Soyuz rocket family

is virtually unchanged from the late 1960s; a small capsule sits atop a 50-meter-tall rocket.

At its base, that rocket is surrounded by four booster rockets to give the entire

mass the necessary oomph when it's first taking off.

And right now, it's the only way we have of sending humans to space.

Two minutes after liftoff, those extra boosters are supposed to break off from the central rocket.

But on October 11, it looks like something went wrong with that process.

Instead of continuing their climb with the new push of the central engine,

the astronauts cited feeling weightless.

They were suddenly in free fall.

Shortly thereafter, the computer automatically triggered a launch abort.

The crew capsule separated from the rocket and fell back to Earth, where it landed safely.

Albeit in the middle of nowhere, but they did find them.

Now all crewed launches are on hold while Russia's space agency

Roscosmos investigates exactly what went wrong.

But that is not good news for the three crew members currently living on the ISS.

They were scheduled to return to the Earth in December, with a new team of three joining

Hague and Ovchinin on the station and continuing operations and experiments.

Now their missions will either have to be extended, or they'll have to abandon the

station in the Soyuz capsule currently docked.

Even though the crew has plenty of provisions, the fuel in that lifepod

is only cleared to last until January.

If the order is made to abandon the ISS, it will be the first time since 2000 that

we haven't had a single person living there.

Now, it's not like the ISS is gonna fall out of the sky if there are no people on it,

but we won't be able to do any maintenance.

Already, the spacewalk Hague and Ovchinin had trained for, to replace the batteries

on the station's solar panels, was cancelled.

For now, Roscosmos plans to try the launch again in the spring of 2019.

With an additional report coming out in the next few days,

hopefully we will hear some good news.

But unfortunately, this is not the only failure space missions have suffered this month.

Less than a week before the failed Soyuz launch, NASA saw two of its space-based telescopes

perform emergency shutdowns.

On October 5th, the Hubble Space Telescope suffered a mechanical failure,

and only 5 days later, the Chandra X-ray Observatory got a bad data reading

that interfered with its momentum sensor.

Because they're a bit too out of the way to send any technicians,

all of our space-faring technology has programming that instructs them to enter a safe mode

when they detect something wrong.

They lock themselves into a safe position, including pointing their mirrors away from

the Sun and their solar panels toward it, and switch over to backup hardware.

It happens more often than you might think.

For example, the infrared Spitzer telescope automatically entered safe mode back in 2006,

and the Dawn spacecraft has done it at least twice - once in 2011, and again in 2014.

It's just weird that two events happened so close to one another, and to a failed rocket launch.

In Hubble's case, it comes down to the failure of one of its gyroscopes,

which allows us to precisely orient the telescope.

During the last crewed service mission in 2009, astronauts installed 6 new gyroscopes,

but with the most recent breakdown, there are only three that still work.

Hubble only runs on three at a time, though, and the gyroscopes are going to break down over time.

This most recent one was in its death throes for the past year.

And if necessary, it is perfectly capable of running on just one.

So this mechanical failure isn't the end of the world; it's not even the end of Hubble.

Unfortunately, when we tried to switch Hubble over to its final backup gyro, the craft kept

reporting that it was rotating 100 times faster than it actually was.

Strangely, it's only the baseline rate that's off.

It is accurately reporting any changes in speed.

But it's enough of a problem that we can't use Hubble at the moment.

Chandra also had a gyroscope problem, although it seems to have just been a temporary glitch.

For three seconds, the gyroscope sent bad data

that made the computer think it was moving faster than it was.

The telescope seems to be back to normal now, but mission scientists

plan to keep an eye on that gyroscope for a while.

These satellite failures are really just a sign of NASA's

ageing soldiers in the battle to study the universe.

Chandra was launched in 1999, and Hubble in 1990.

Still, both telescopes are doing some amazing and great science up there,

so here's hoping we get at least a few more years out of them.

People who Disappeared in National parks Bizarre True stories, Missing 411 [Part 1/2] - Duration: 18:07.

There is a strange phenomena occurring

where people have gone disappearing in our national parks?

Some are showing up alive days later with no memory of what happened to them,

others have simply vanished without a trace,

And some have even shown up in places where

searchers had already looked for them.

Many believe the parks themselves are covering up

these strange and mysterious disappearances

And if that's the case, why would they do such a thing

All of this and more on today's episode of Edge of Wonder.

Welcome to Edge of Wonder , I'm Ben

and I'm Rob

So this one we were getting a lot of comments asking us about it

and one of our fans Stephanie Farlow posted something about it to my FB page

which inspired more people joining in who all wanted to know what was going on.

So Ben and I didn't know too much about this,

I mean we heard of it but it wasn't completely on our radar,

since we have been really focused on the deep state.

So we started to look into it

and man let me tell you guys, the more we looked into this the stranger it got.

And like everything else, it has got the illumidonkey written all over it.

Yep, but to give you an example of the strangeness of this,

there was one case where a little boy whose body was found lying on a fallen tree

but the unexplained aspect of this is that the trail searchers walked through

and search that entire area for days

and suddenly the body shows up out of nowhere.

In another case a 2-year-old child was missing and after a couple of days,

it was really misty and the search dogs started to act really strange and out of nowhere

the little girl came walking out of the mist completely naked

and scared to death

but couldn't say what happened to her.

They thought she was with a large animal which somehow protected her.

Recently there was a documentary called "Missing 411",

based on a series of books written by David Paulides

who had more than 20 years of experience in law enforcement

including the SWAT Team and Street Crimes unit on the San Jose Police Department.

Paulides started to get involved in missing persons cases

after a government employee went to go see him for help.

When Paulides heard the stories

it only brought up more intrigued and mystery into these disappearance

with even more unanswered questions.

Soon Paulides started dedicating his life

to understand these mysterious disappearances.

And mystery just doesn't cut it,

I mean this is getting into real life Stranger Things here

and Paulides even started to think in this direction.

During a talk at the University of Toronto

Paulides said it was "It's like something out of the X-files"

So this isn't just some paranormal hobbyist,

this guy seriously has dedicated his life to help figure out

and understand what is happening with these missing person cases.

He also collected over 2,000 cases that have similar mysterious characteristics.

To date Paulides has some 2000 missing cases documented related to national parks

but this is where the weirdest part comes in,

there is no requirement from our government to keep a national record

for people who go missing on Federal Land.

Why, that's the big question everybody is asking.

But if you count the missing people in the U.S. as a total,

it is a whopping 650,000 just in 2017!

I mean this isn't remotely funny, this is crazy.

Of course that also counts parents abducting their own children to avoid child support,

but this is a huge number.

But for the 1600

which some say is a very low estimate,

has missing people range from all ages and all ends of the spectrum

when it comes to age and mental capacity.

Some have mental problems,

some are actually extremely brilliant and accomplished people.

Even when the movie Missing 411 requested this info

they were told that there were no records

and to deliver one would cost the production company $1.4 million

which was probably more than the film cost to make.

So the other interesting fact is that the Secretary of Interior

is the person who oversees the U.S. national parks,

he is appointed by the president.

Ken Salazar held this position during Obama's first term

and was interviewed by the Missing 411 film crew.

He was asked asked if there was public records

and he just said, "I don't recall."

when we were watching this,

I thought it was odd that the only thing in this room

was a telescope that was pointing at a building

For some reason, and look what's the name on the telescope

Saturn

If you haven't watch our saturn videos you probably want to go do that now.

So now that's just the name of the company,

but it is kind of odd that it is the only thing in the room.

Maybe the film crew left this in on purpose,

I mean having the telescope named Saturn might just be a coincidence.

But this is isn't normal to have this being the only thing in there, is it?

pointing at building

Now, when Ken was asked about records kept

he said there is no record keeping of searches

which seems very stupid

because how would you ever know what worked or didn't work

or find patterns for future searches.

That just screams red flag,

also it was would very easy to hide things

so no reports need to be filed or written up.

But let's get into some of these super weird cases.

So according to Paulides

many of these cases are clustered in certain areas,

particularly around bodies of water in national parks.

If the people are found alive, they often have memory loss.

If they are found dead, the cause of death is hard to determine.

The people are often found in an area it seems they could not have reached by foot

such has on a steep rocky cliff,

or they are found in a location

that has already been thoroughly searched.

People are often missing clothes and shoes.

Search and rescue dogs are strangely unable to pick up the scent,

Paulides said at the University of Toronto.

Some canine handlers have told Paulides their search dogs act strangely,

walking a little ways, circling, then sitting down.

Now, many people claim that dangerous wildlife are the cause of these disappearances,

but there is never any mauled bodies,

tracks from animals, clothes ripped from an animal or blood anywhere.

Also not to mention in the last 100 year

there has only been 14 fatal mountain lion attacks in the U.S. and Canada combined.

So this doesn't hold up at all.

The other aspect is that a family member or parents killed the child or person.

You'd think that there'd be way more mountains lions attacks in Canada,

Canada is like mountain lions jungles I think, just kidding.

I am sure that in some cases this is sad

but most law enforcing agencies usually come about

and rule out the parents.

But there is one family who is being accused

but when you listen to their testimony

and the fact they have been out every day since their son was missing….

This just doesn't add up.

No

The issue is people want answers so they start pointing fingers to fill this gap.

But there are also so many things that the parks are also covering up

that this is why we think the deep state is involved.

For example there is no federal standards for terrestrial search and rescue

according to Robert Koester,

author of the search and rescue guidebook "Lost Person Behavior".

So again this means that rules and regulations are loose on national parks.

But ok let's get into some of these cases…..

In one case back in 1952,

2- year-old Keith Parkins walked around the family barn

and suddenly disappeared.

200 people were called to his rescue when his family couldn't find him.

They searched everywhere.

Hours after he was missing and 3 miles as the crow flies of his last location,

a small amount of tracks from a toddler were found.

They started out of nowhere and seem to end nowhere as well.

19 hours later, his body was finally found lying face down in the snow

another 8 miles away which was in a dense area on top of a very rocky cliff.

His father picked him up

and realized he was still breathing with scratches on his face.

Some of his clothes were found lying around him.

He ended up being ok

but never could remember what happened

or how he was able to walk through 12 miles of snow

and tough dense terrain in 19 hours while only 2 years old.

I mean it seems most logical that you would just go back to the barn.

Another eerie fact is that most of the missing persons are often found

in bodies of water, but they didn't die of drowning.

Almost as if their body was placed there.

Jelloni Brinson, a 24-year-old college soccer star

whose body was found in a golf course pond in Anoka, Minn.

He went missing from a friends' home in 2009,

investigators found his hat in one backyard nearby, and his shoes in another.

But this is the unbelieve part,

It had been raining for days previously

and the golf course was muddy.

Brinson's socks were completely clean.

So he was placed in the pond by either someone or something.

Also Paulides said that he didn't drown,

The cause of death remains undetermined to this day.

In January of 2014 in Whitby, Ontario,

Jeffrey Boucher went missing after going out for a morning run

and never came back.

His wife said that he would come home,

change his clothes kiss her goodbye and head for work.

His mp3 player, some running clothes, His glasses and wedding band were all missing.

Soon everyone was out looking for him.

Police ruled out suicide and any foul play from his wife.

Police found thirty-five-hundred dollars in a desk

at the school that he taught

but school officials said that he was collecting this money for a skiing trip with his wife.

Months later his body washed up on shore at Lake Ontario,

but the weird thing is according to Paulides his body was frozen but the lake wasn't.

Also a book came out saying it was a suicide yet no evidence ever suggested it was.

One of the more recent and disturbing disappearances is

Deorr Kunz Jr.

which is also the main family featured in "Missing 411"

and one that has gotten the most attention from all news outlets

and law enforcement agencies.

Deorr was 2-and-a-half years old

when he vanished at Timber Creek Campground near Leadore Idaho.

His parents Jessica Mitchell and DeOrr Kunz Sr.,

asked him if he wanted to go with them

but he said he wanted to stay with his grandfather

so he walked back over to him.

His grandfather said that he saw him,

and then he went inside the trailer for 10 min

and when he came out back to fish with his friend Isaac Reinwand,

DeOrr came running up asking where little Deorr was.

No one knew and that is when the panic set in.

Jessica and DeOrr Sr. got in their car

to find a signal for their phone to call for help,

because there was no signals near that area.

They got through and then the madness set in with the media,

search teams came,

and they started accusing the parents

all while going through the nightmare of losing your child.

They started to give press conferences

but soon quit talking to the media

which gave then rise to all kinds of speculations that they were the ones that did it,

or maybe it was the Isaac, the friend, or the grandfather.

The family finally hired a private investigator,

but I'll get into that a little bit later

and now this private investigator is about to release his own videos in October

interviews that he had with these parents,

and it seems that he's about ready to blame the parents

for their son's disappearance.

However, watching Missing 411

they explain that the media was twisting and misquoting them,

no surprise there,

so that is why they stopped

and spend their whole weekends and their own money still searching for their son.

They are not giving up hope

This just doesn't add up.

The issue is people want answers

so they start pointing fingers to fill this gap

that is filled with mystery.

But there are also so many things that the parks are also covering up

that this is why we think the deep state is involved.

Somehow involved.

There hasn't been a single trace of clothes, bones, foot prints,

nothing has been found which makes this really bizarre

and gives rise to lots of speculation.

The family believes he was abducted somehow.

The only thing ever found was by Jessica

which was a shovel which had a blonde hair on it

but when the team moved it, The wind blew it

And it was never found again.

Now we wanted to look a little bit into this private investigator,

he said he quit but the family said they fired him.

What is interesting is that there are a few sites dedicated to call him out on fraud charges

such as this site: ViaView Files

and another one insinuating he has over 50 lawsuits against him.

Might wanna do your research before hiring a investigator.

He's got some credibility on his website,

but when we look into him, these things keep popping up.

Jeez.

Some of these go waaay back such as 6-year-old Lillian Carney who disappeared in 1897.

She was picking blueberries,

and by the way many reports say people go missing picking fruit,

with her parents when she just was not there.

They searched for over an hour

and finally got more people to help

and by morning over 200 people were searching.

The following day over 300 people were looking for her

and that is a lot of people back in 1890

helping out since of course phones didn't exist.

So they finally found her after days out of nowhere,

and she couldn't remember anything that happened,

but the weirdest part is, she said it was daylight the entire time she was missing.

Entire time, how long?

Like 48 hours.

Daylight the entire time?

Daylight the entire time.

Where was she, the north pole?

Time slip?

This is bizarre.

This is why everyone is questioning these things.

So let' s go into conclusion, what is happening?

Well the more we researched this,

the more connections we found

and one case was so shocking to us

that from this we knew this has to be a cover up.

But the question is, if it's a cover up for what?

But this is where the truth becomes stranger than fiction.

Because these cases don't follow normal patterns

you need to expand your thinking into all possibilities.

In Paulides' own words "Folks, I have never given you a theory.

I have given you a series of facts,"

"What happens if I come out and I tell you,

'It's that.'

And then the next day somebody comes out and proves it can't be that.

My credibility is shot."

Now when you dig,

you start realizing Paulides talks about the paranormal a lot outside of the mainstream realm.

And one common theme and rather hard to except to the average people would be...

Aliens.

No don't laugh yet.

Yea we are not talking about little green men coming from the sky

and abducting people.

This would be a very highly organized top secret

cabal type facilities that we are talking about here.

We already know by talking to so many insiders that secret military bases do exist.

Also the search teams seem to be covering up evidence

and what really is the job of the the Secretary of Interior,

to assist or to cover up?

And who knows if there are bases under these parks.

But we will get into all the details of this

and the most mysterious missing persons case we found in our next episode.

Also we said earlier that 650,000 people missing alone in just the U.S. last year?

Millions of people around the world go missing

and what is happening?

We get into this on the next show as well.

But we don't like leaving on a negative note.

You guys might be wondering what can we do?

For starters, don't go wander off in parks

or especially national parks alone.

Take GPS devices with you,

stay together and pay attention to your surroundings,

bring water and food.

Also make sure you know the people you are with.

If you need to report something,

it is better to call you local police

and if you have some information on someone

or you know something you can call crime stoppers.

Try to stay calm when you are calm you can think things more clearly.

It's kind of hard to say.

Comment on these cases if someone does go missing.

Also, I know this sounds kind of bad,

but don't just blindly trust everyone you meet.

Do your own research too.

But seriously, if the parks released the number of missing people,

all of us might would most likely be afraid to go there alone.

Which is probably why they don't do this.

Alright you guys, what did you think of our episode of missing people?

Please hit like and subscribe if you like this content.

So we can keep producing more of it for you guys

and until next time we'll see you out on the edge.

And stay tuned definitely for our next one

which we'll blow your minds,

how crazy it gets.

Indeed.

Wake County Raleigh Real Estate News: 3rd Quarter Market Update - Duration: 6:13.

Hey friends, this is Ellen with Harmony Realty Fathom. Today we are looking at

the market statistics for the third quarter of 2018 I like to pull three

metrics when I look at these things. I like to look at the median price sold in

each individual city in the Triangle. I'm focusing on Wake County today...the number

of expired's in each county and the percent increase or decrease of those

and the number of days it took to sell a home in each city. So today we're going

to look at those, so stick around we'll be getting to that in just a minute.

I like to run these statistics usually four times a year at the end of every

quarter and I definitely like to do a one-year at the end of the year. So in

January I'll put up in another video that'll be of the whole year rather than

just a quarter. It's really important to kind of stay on top of these things

because markets change. They're up and they're down. It's been a seller's market

for a long time now and eventually it's gonna shift to a buyers market. And I

like to know that sooner rather than later. So getting into the numbers. In

Wake County there was a 7% increase in property values. The days on the market

went down from 9 to 4; that is a decrease of 56% and there was a 25% decrease in

expired listings. In Cary there was a 7% increase in median property value,

there was a 37 percent decrease days on the market and a 42% increase in

Expired Listings. In Apex there was a 7% increase in property values,

there was a 66 percent decrease in days on the market and there was a 21% decrease

in expired listings. In Holly Springs there was actually a decrease by 3

percent in the property value. So I just want to say here, because we see this in

a couple of places this quarter, just because there was a decrease that

doesn't mean, first of all it doesn't mean that there's a trend. You need to

see that happen more than one time before you know that property values are

trending lower. Secondly we're just talking about the median value we're not

really talking about, you know, the size of the home or the types of features in

a home so it could be that in Holly Springs they're building more, for

example, town homes than building single-family homes [and maybe] this time

last year there were more single-family homes that were a little bit bigger. And

that would make sense to me because it's really hard to find inexpensive homes or

affordable homes right now and there's a lot of new construction going

on in Holly Springs so it wouldn't be surprising that those builders are

turning towards more densely packed property to try and meet that need for

affordable homes in Western Wake County. So down 3% with the median

value, down 66% with the days on the market. That's another clue that it's not

really a downturn in the market because houses are selling a lot faster, 11 days

last year to sell a house and four days this year to sell a house, that's a clue that

it's not really the market turning but that just may be a change of the type of

inventory that we're seeing. In Fuquay the median value is up 6%, days on market

is down 66% and expired listings are down 52%. Morrisville was our other area

that went down a little bit in value; down 3% in Morrisville for median value,

down 33% for days on the market and up 52% for expired listings. So this one was

our winner this year or this quarter... Garner property values are up 13%, days

on the market is down 86% from 15 days to sell last year to 2 days to sell this

year. That's kind of crazy and expired's are up 27%. Knightdale is also down 2%.

Now Knightdale was one of our ones that last time we did these numbers it was up

like 20 percent so we're netting like 18% or something like that still very

very good gains in Knightdale and I expect to see some more gains because

their average or their median is 223,000. Knightdale is a nice little

town, really really affordable, really convenient. You know you're minutes from

downtown Raleigh, minutes from North Hills, everything you could pretty much

need in Knightdale, but still a very affordable home with low crime. You know it's,

I think, one of the up-and-coming areas. So even though prices are down slightly

I don't expect that one to be a trend, so days on the market are down 42% in

Knightdale and expired listings are down 88 percent, that's quite a bit. Wake

Forest -- Wake Forest is up 4 percent for the median value, days on the market is

down 80 percent, that's kind of crazy, 20 days to sell a home last year at this

time and four days to sell a home this year at this time. That's a big jump

and expired's are down 50%. For a while there I was thinking that Wake Forest

might have kind of outlived the the high roller coaster ride of the market

because it's a little bit farther removed from things. The traffic on

Capital Blvd can be really challenging and prices were starting to really creep up

there. So I was thinking, you know, for the location and the price of home there you

know 336,000 it's quite pricey. Not that much less than like Cary, for

example, but you don't have the convenience that you have in Cary. So I

was thinking maybe they'd already, you know, seen seeing their max price

increases. But this shows that that's probably not the case. And then last but

not least, Raleigh is up nine percent with a median value of 270 thousand this

year. Days on the market are down 29% and expired listings are down 30%. Thanks so

much for watching you guys. Don't forget to subscribe. I'm going to be posting

these videos specifically the statistics videos will come out four times a year.

But i'm gonna be posting a lot more videos about the area so you can get to

know it and all the great things that we have to

love about Wake County North Carolina. So click that subscribe button and

thanks for watching. Have a great day!

John Kelly & John Bolton Have Profane Shouting Match Outside Oval Office - Duration: 3:44.

On Thursday of this week, according to witnesses inside the White House, there was a massive,

profane shouting match outside of the Oval Office between Donald Trump's Chief of Staff

John Kelley and his National Security Advisor John Bolton.

The two of them were allegedly arguing about immigration, specifically Donald Trump's repeated

claims that there is this massive caravan of people headed to the United States to cross

our border.

They're all mad about it, obviously, and so the two, Bolton and Kelley, were arguing over

the effectiveness of Department of Homeland Security Chief Kirstjen Nielsen.

Now, John Kelley, according to those who witnessed the argument, was defending Nielsen saying

she's doing a good job protecting our border.

She's doing a good job putting all those little kids in cages.

John Bolton, on the other hand, was unhappy.

She wasn't doing enough.

Maybe there aren't enough kids in cages, and maybe we don't have enough cages on hand to

put everybody from this massive caravan into cages.

The Trump administration right now is hoping ... and this is an aside to the little argument.

We'll get back to that in a minute.

They're hoping, right now, that this alleged caravan of migrants coming to the United States

is going to give them a boost in the midterms.

That's why they're talking about it nonstop, and that's actually why Donald Trump is out

there blaming the Democrats for this caravan, like somehow the Democrats did this.

Matt Gaetz, my idiot congressman, who might actually be the dumbest person on the planet

at this point, is spreading a conspiracy theory right now that George Soros paid these people

to join an immigrant caravan down in Honduras and make the trek all the way to the United

States.

Matt Gaetz, a Republican congressman, is actually spreading that conspiracy theory right now.

Back to the fight.

Right?

That's what everybody wants to know about, John Bolton and John Kelley profanely screaming

at one another.

Well, unfortunately, there's not too much to add to that, other than people said that,

at the time, they figured when this fight was over, it was basically going to end with

either John Kelley or John Bolton immediately resigning on the spot.

Neither happened.

Both men still in the White House.

According to Sarah Huckabee Sanders, there was a disagreement, but there's no animosity.

There's no hard feelings between anyone there in the White House.

Everybody's friends.

Things just sometimes get a little heated.

The White House is falling apart.

It's falling apart from the inside.

None of the people get along with one another.

Sarah Huckabee Sanders still, to this day, incapable of telling us the truth about what's

actually happened, and the only way we get accurate reports is when witnesses inside

the White House decide to talk to the press.

This entire administration is falling apart.

They're relying on conspiracy theory talking points to try to energize their base ahead

of the midterms, and the American people are suffering as a result of it.

I'm terrified to think what this administration is going to do as that group of immigrants

gets closer to this country.

Trump has threatened to send the military down there to shut down the border, and if

that happens, you can guarantee that there will be killings at the hands of the United

States military trying to protect this border from Donald Trump's imaginary threats.

DJI Osmo Mobile 2 with Android PANORAMA - Duration: 7:58.

Today's video will be all about panorama. How to make them with DJI Osmo

Mobile 2 and Android phone. What the resolution is? How to make them even

bigger with using another apps... stay tuned, all is coming up.

And for those

watching my channel first time. My name is Zdenka Darula.

I'm a photographer and former model and few other things. I make tutorials and

fun Vlogs so don't forget to hit the subscribe

button.

When I was buying DJI Osmo mobile 2 gimbal all I wanted it for is a very

smooth video. I didn't even know to be honest that it has this very powerful feature

which is creating stunning panoramas. I love taking photos with my Android

phone which is Samsung Galaxy s6 and I could try to make panoramas just with

the phone but try to hold it steady. It is almost impossible I never got the

panorama right so here comes really handy this tool which is Osmo Mobile 2

gimbal. That will make you those panoramas so much easier to make.

And I gotta say I have a lot of fun watching the gimbal to actually make the

panoramas. So I'm going to go ahead and open up DJI Go application I'm going to

switch it to photo mode and actually in the settings you can select if you want

to save all unstitched photos or not. I don't have it selected so it will ask me

every time I make panorama if I actually want to save all unstitched photos

as well. Sometimes I save them sometimes I don't.

It depends what I want to do with them for example if I wanna use it for

Instagram or if I want to create bigger panoramas by using another app which I

will show you later on in this video.

So I'm going to hit the panorama button and here I have three choices. It's ultra

wide-angle or 180 panorama or full 330 degrees panorama.

The first one we are going to do is ultra wide-angle panorama. It will take

nine photos in total and before you actually start I strongly suggest to

lock down the exposure.

Now I'm going to save all unstitched photos for later on and also I'm going

to show you some panoramas I took in Czech Republic and in Slovakia when I

was there in summer so here are some samples of ultra wide-angle panoramas.

Now I'm going to move on to 180 degree panorama. The gimbal will take 15 photos

for me.

Here we go. Now it is processing. So I am going to save again all unstitched

photos for later on. And here is the final size of the 180 degree panorama

and here are some samples of 180 degree panorama from Czech Republic and

Slovakia.

And finally I'm going to do the full 330 degree panorama. It's going to take 27

photos. It is not the full 360-degree panorama because it will take photos of

me as well. So it's going to start over here and it's going to finish over there.

And again I'm going to save all unstitched photos for later. And here's

the final result of three thirty degree full panorama and also here are some

samples of other three thirty degree full panoramas.

So I'm finished here with the making panorama so let's go to my office and I

will show you the panoramas how you can make them even bigger. I need to warm up

a little bit and maybe get some coffee or tea....let's go....

It is so much better. I am finally feeling my hands again... anyways now you are in my office and I promised you that

I'm gonna be talking about panoramas and how to make them even bigger. All you

have to do is download application called BIMOSTITCH. Now I linked it in a

video description below so you can just grab it right there. It's called Bimostitch.

All you have to do is bring those unstitched photos inside of the

app and it will create much bigger pants for you. I'm going to hit the plus button

to import the photos and what is so nice is that the DJI Go app is actually

separating these panoramas into different folders so I'm looking for a

folder which has nine photos that means is the ultra wide-angle panorama. So I'll

hit the button and I am uploading all the photos. Then I have to just wait for

the app to actually create the ultra wide-angle photo. So here is the final

result of ultra wide-angle photo created by Bimostitch and we are actually

going to compare both of them so here is a ultra wide-angle photo from DJI Go app

and it's size and here is ultra wide-angle photo created by Bimostitch.

and it's size and definitely Bimostitch is creating much bigger final results.

Next I'm going to create the 180-degree panorama so here the Bimostitch is

finally finished and we are seeing panorama number two which will be the

180-degree panorama now here is the actual size and let's go compare again

DJI Go panorama and size of Bimostitch so here you see those sizes together and

you can see again Bimostitch creates a bit bigger final image. And we have one

last one panorama to create and that will be obviously the full panorama 330

degrees so let's go ahead and bring images in the Bimostitch and here is

the final panorama created by Bimostitch it is a full panorama now I have to

say sometimes the full panorama works very well sometimes doesn't. I would

definitely recommend it for ultra wide-angle panoramas and 180 degrees

panoramas. Well I hope you liked today's video and you get something out of it if

you did please don't forget to give it a thumbs up and subscribe for more future

videos. If you have any questions or comments feel free to write them below

as you know I always respond to every single person and I love hearing from

you. Sso thank you for watching that's it for today.... Cau... Ahoj.... Oh
