- I'm still not divorced. Can we apply for a Partner Visa?
This is an awkward one.
So, if you're not divorced,
if one parties or both parties to the application
are not yet divorced, there may be situations
where you can still apply for the Partner Visa
but it would on de facto grounds.
For that to happen you'd need to have been
in a de facto relationship for 12 months
before applying for the Visa.
There's no need to have that divorce through at any point
as long as you can meet that 12-month de facto.
